NOT!CED Terms of Service

Welcome to NOT!CED Pty Ltd (“NOT!CED”, “we”, “our”, “us”). These Terms of Service govern your use of our website, retail store, magazine, modelling agency (NOT!CED ANGELS), and all related services. By engaging with NOT!CED in any capacity, you agree to these Terms.

 

 

 

General Terms (Applies to All Users)

  • You must be at least 18 years old or have parent/guardian consent to use our services.

  • You agree to provide accurate and up-to-date information.

  • You must not misuse our platforms for unlawful, harmful, or fraudulent activity.

  • Intellectual property (including our brand, website content, photography, and creative works) remains the property of NOT!CED or our collaborators unless stated otherwise.

  • We may update these Terms at any time, and the updated version will be effective once posted on our website.

 

 Customers (Retail, Magazine, Events)

  • Orders & Payment: All orders are subject to availability. Prices are listed in AUD and may change without notice. Payment must be made at checkout via secure third-party payment providers.

  • Shipping & Returns: Customers are responsible for providing correct delivery information. Returns, exchanges, and refunds are handled in line with our Refund Policy [link].

  • Subscriptions: Magazine and newsletter subscriptions may be managed or cancelled at any time. Refunds for partially used subscriptions are at NOT!CED’s discretion.

  • Events: Tickets or RSVPs are non-transferable unless otherwise stated. Event access may require ID or confirmation of registration.

  • Liability: We are not responsible for delays, damages, or losses caused by third-party carriers or circumstances beyond our control.

 

 

Collaborators (Designers, Brands, Artists, Contributors)

  • Agreements: Collaborations (consignments, loans, features, or contributions) must be supported by a signed agreement (e.g., consignment contract, brand loan form).

  • Intellectual Property: Collaborators retain ownership of their brand assets, designs, and creative works. By collaborating with NOT!CED, you grant us a limited right to use your content (logos, images, samples) for marketing, editorial, and promotional purposes unless agreed otherwise.

  • Loans & Consignments: Items provided for shoots or sales remain your property unless sold or otherwise agreed. Damages, losses, or late returns are handled in line with signed agreements.

  • Termination: Collaborations may be ended by mutual agreement or in accordance with contract terms.

 

 

 

NOT!CED ANGELS (Applicants & Represented Models)

  • Applications: Submitting an application to NOT!CED ANGELS does not guarantee representation, casting selection, or bookings. Applications are for evaluation purposes only.

  • Castings: Attendance at castings does not ensure selection. NOT!CED reserves full discretion in model selection.

  • Representation: If offered a contract, models must sign a formal agreement outlining commission rates, booking terms, and representation obligations.

  • Conduct: Models are expected to maintain professional conduct at castings, shoots, and client engagements. Breaches may result in termination of representation.

  • Payments: Models represented by NOT!CED ANGELS will receive payment for bookings in line with their contract. Agency commissions will apply.

  • Termination: Representation may be terminated by either party in accordance with the signed model contract.

 

 

Liability & Disclaimers

  • We make no guarantees about opportunities, sales, or outcomes for customers, collaborators, or models.

  • To the extent permitted by law, NOT!CED is not liable for indirect, incidental, or consequential damages.

  • Our services are provided “as is” without warranties of merchantability or fitness for a particular purpose.

 

 

Governing Law

These Terms are governed by the laws of New South Wales, Australia. Any disputes will be resolved through negotiation, mediation, or in the appropriate NSW courts.
